What happens if the person cannot be served?
If Golden Process Service is unable to complete personal service after diligent attempts, we provide a detailed Non-Service Report documenting every attempt with dates, times, and GPS coordinates. Your attorney can then consider other options, such as substitute service at the residence or, after a diligent search, constructive service by publication under Chapter 49. What is an Affidavit of Diligent Search and Inquiry?
An Affidavit of Diligent Search and Inquiry is a sworn document filed with the court when a party cannot be located for service. It details the steps taken to find the individual, including database searches, address verification, and field visits. What is substitute service and when is it used in Florida?
Substitute service means leaving the papers at the person’s usual place of abode with someone who lives there and is 15 or older, after telling that person what the papers are. It is authorized by §48.031(1)(a), Florida Statutes, as an alternative to handing the papers to the defendant personally. Golden Process Service follows all statutory requirements for valid substitute service, ensuring your serve holds up in court.
Can papers be served on a Sunday in Florida?

What must a Florida return of service include?
Under §48.21, the return must state the date and time the process came to hand, the date and time it was served, the manner of service, and the name of the person served, plus that person’s position if they were served in a representative capacity. Leaving those facts out invalidates the service until the return is amended, so we check every return before it goes back to you.
Can a process server get into a gated community?
Yes. Section 48.031(7) requires a gated residential community, including a condominium or cooperative, to grant unannounced entry to a person attempting to serve process on someone who lives there. How do you serve the State of Florida?
Under §48.121, process against the state is served on the state attorney for the circuit where the case is filed, and two copies are sent by registered or certified mail to the Attorney General.
